Acceptance of these Terms
These Terms and Conditions (the “Terms”) are an agreement between you and Courtinate (“Courtinate,” “we,” “us,” or “our”) governing your access to and use of courtinate.io and related Courtinate services (the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of a school, club, team, or other organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” includes both you and the organization.
Eligibility and accounts
You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. You must provide accurate, current information and keep it updated. Eligibility for a school, club, roster, or tournament is determined by the applicable organization or host, not by Courtinate.
You are responsible for protecting your credentials and for activity under your account. Do not share an account or use another person’s account without authorization. Contact support@courtinate.io promptly if you believe an account has been compromised.
The Service and organizational roles
Courtinate provides tools for tournament discovery, school and team administration, registrations, rosters, scheduling, draws, brackets, standings, results, forums, notifications, and related coordination. Features may change as the Service develops.
School administrators and tournament hosts are responsible for confirming that they have authority to manage their organization, invite members, publish information, review registrations, and make competition decisions. Courtinate may review, approve, reject, suspend, or remove organizational access when reasonably necessary to protect the Service or its users.
Tournaments, registrations, and fees
Tournament hosts—not Courtinate—are responsible for tournament information, eligibility requirements, acceptance decisions, schedules, facilities, safety, officiating, scoring, cancellations, refunds, and compliance with school, league, and legal requirements. Participants should independently confirm important details with the host.
Courtinate may display registration fees or other amounts entered by a host, but Courtinate does not currently process payments. Any payment, refund, or financial arrangement is directly between participants and the relevant host or organization. Courtinate is not responsible for those transactions.
Submitting a registration does not guarantee acceptance or participation. A host may accept, waitlist, reject, or cancel a registration subject to its published rules and applicable law.
Acceptable use
You agree not to:
- Use the Service unlawfully, fraudulently, or deceptively.
- Harass, threaten, impersonate, discriminate against, or endanger another person.
- Submit content that is unlawful, defamatory, infringing, invasive of privacy, sexually exploitative, or otherwise harmful.
- Misrepresent authority, eligibility, identity, results, registrations, or affiliation with a school or organization.
- Access accounts, data, systems, or areas of the Service without permission, or attempt to bypass security or usage restrictions.
- Disrupt the Service, introduce malicious code, scrape at unreasonable volume, or use automated means that burden or damage the Service.
- Reverse engineer or copy the Service except where applicable law expressly permits it.
User content
You retain ownership of content you submit, such as school information, tournament details, logos, roster information, and forum posts (“User Content”). You represent that you have the rights and permissions needed to submit that content and make it available through the Service.
You grant Courtinate a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, distribute, and otherwise use User Content as reasonably necessary to operate, secure, support, and improve the Service. This license lasts while the content is maintained through the Service and for a reasonable period in backups and records.
You are responsible for avoiding unnecessary sensitive or confidential information in public fields. Obtain any required permission before entering another person’s name, contact information, image, or other personal information.
Moderation and enforcement
Courtinate may review, restrict, remove, preserve, or disclose User Content when reasonably necessary to operate the Service, enforce these Terms, respond to reports, protect people or property, or comply with law. We are not obligated to monitor all content and do not endorse content submitted by users.
We may warn, limit, suspend, or terminate accounts or organizational access for violations, risk to the Service or users, legal requirements, prolonged inactivity, or discontinuation of the Service. Where practical, we may give notice or an opportunity to address the issue.
Third-party services and links
The Service depends on third-party infrastructure and may display maps, routes, school information, links, or services provided by others. Third-party services are governed by their own terms and privacy practices. Courtinate is not responsible for third-party services, content, availability, or conduct.
Courtinate intellectual property
The Service, including its software, design, branding, logos, text, and other materials provided by Courtinate, is owned by Courtinate or its licensors and is protected by intellectual-property laws. Subject to these Terms, Courtinate grants you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose.
No rights are granted except as expressly stated. Feedback you provide may be used by Courtinate without restriction or compensation, but we are not required to use it.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” COURTINATE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Courtinate does not warrant that the Service or user-provided information will be accurate, complete, uninterrupted, secure, or error-free. Participation in sports and attendance at events involve risks. Courtinate does not organize, supervise, insure, or control tournaments and is not responsible for injuries, property damage, travel, facilities, weather, participant conduct, or host decisions.
Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURTINATE AND ITS CONTRIBUTORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURTINATE’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID DIRECTLY TO COURTINATE FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Courtinate and its contributors and representatives from claims, damages, losses, liabilities, and reasonable costs arising from your User Content, your use or misuse of the Service, your tournament or organizational activities, or your violation of these Terms or another person’s rights. Courtinate may control the defense of a covered matter, and you agree to cooperate reasonably.
Governing law and disputes
These Terms are governed by the laws of the State of Ohio and applicable United States federal law, without regard to conflict-of-law principles. Any dispute that is not resolved informally will be brought exclusively in a state or federal court with jurisdiction in Ohio, and you consent to the personal jurisdiction of those courts.
Before filing a claim, you and Courtinate agree to try in good faith for 30 days to resolve the dispute informally. Send a written description of the issue and requested resolution to support@courtinate.io.
Changes and general terms
We may update these Terms as the Service changes. We will post revised Terms and update the date above. Material changes may receive additional notice. Continued use after revised Terms take effect means you accept them.
If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Courtinate may assign them as part of a reorganization, financing, acquisition, or transfer of the Service. These Terms and the Privacy Policy are the entire agreement about the Service unless a separate written agreement applies.
Questions about these Terms may be sent to support@courtinate.io.
